These terms apply to any music, recordings, stems, demos, scores, videos or anything else shared by Jessica Roch ("the Music") that is linked to or attached to an email from me, or shared with you in any other way. This includes any of my music currently online. By opening, downloading, streaming, recording or keeping the Music, you agree to these terms.

1. Ownership

All rights in the Music, including copyright in the compositions and the sound recordings, belong to Jessica Roch (and to any named co-writers, labels or publishers where relevant). Sharing the Music with you does not transfer ownership or grant any licence beyond what is set out below.

2. Permitted use

You may listen to the Music only for the purpose it was shared with you, for example to review it, consider it for a project, or discuss a collaboration. Any other use, including broadcast, synchronisation, public performance, publication, sampling or passing it on to anyone else, requires my prior written permission.

3. No use with artificial intelligence

You must not use, or allow anyone else to use, the Music (in whole or in part, including stems, extracts, samples, metadata or descriptions of it) to:

• train, fine-tune, test or otherwise develop any artificial intelligence or machine learning system

• create AI-generated material based on, imitating, or "in the style of" the Music

• upload to any AI music generation, stem separation, voice or instrument cloning, or audio analysis service

• carry out text and data mining, scraping, or dataset building of any kind

This applies whether the use is commercial or non-commercial. I expressly reserve all rights in the Music against text and data mining, including under Article 4(3) of EU Directive 2019/790 and any equivalent law in any other country.

4. Watermarks and metadata

The Music may contain embedded metadata, audio watermarks and/or digital fingerprints that identify it as my work and allow its use to be traced. You must not remove, alter or obscure any of these.

5. Unreleased material

Unreleased Music is shared in confidence. Please do not share, post or play it publicly without my written permission.

6. Breach of these terms

If the Music is used in breach of these terms, I will take action to protect my rights. This may include legal proceedings for copyright infringement and breach of these terms, seeking damages, an injunction and recovery of my legal costs, and notifying any platform or service involved.

7. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
